TERMS OF CARRIAGE SERVICES DESCRIBED IN THE BROCHURE / THE WEBSITE
Brochures are printed several months before services are scheduled. Accordingly, the brochure / website describes these services as accurately as possible, as of this date. The right to alter or modify the travel services and the itineraries in any way remains with us. This is a possibility due to conditions that may be beyond our control such as 'force majeure' events, festivals, fairs, strikes, weather conditions, sport events, traffic problems, overbooking of flights / hotels, re-routing / cancellation of railway or flights, restricted entry or closure of a place of tourist interest for sightseeing. We may be able to inform you in time, wherever we get to know any such information, otherwise our Train Manager or representative/s will be able to let you know of the changes regarding the tour.

ITINERARY CHANGES
The right to amend or withdraw a tour itinerary, travel arrivals or departures, rests solely with the Train Manager. The Services will remain the same.

REGISTRATION
Booking by the Traveller
You have read and understood the Indian Maharaja Brochure / Indian Maharaja Itinerary, and the 'Terms and Conditions' and accordingly signed the Terms & Conditions and the Booking Form which will be binding on the parties and shall constitute a contract between the parties upon your signing the same and making payment towards the booking amount as prescribed.

Booking by a Co-Traveller
In case that one or a few but not all of the Clients have signed the 'Booking Form', it shall be deemed / understood that all such have duly authorised the concerned main Client to sign on their behalf.

Booking through a Travel Agent
If a Travel Agent, instead of the Clients, on whose behalf the tour is to be booked, signs the Booking Form for and on behalf of the persons mentioned in the Booking Form, it shall be construed and deemed that all such persons mentioned in the Booking Form have duly authorised the aforementioned travel agent to sign on their behalf. The signing of the Booking Form by your travel agent or by you shall mean complete acceptance, by all of the Clients, of the Terms and Conditions contained herein.

You can, as per your convenience, log on to www.theindianmaharaja.com and book your tour online.

The Company reserves the right to not authorize or decline to Register or book any person/s as Client/s for any Tour or to cancel their registration without giving any reasons whatsoever.

DEFINITIONS

  • They / You / Client / Them / His / Her means the person/s in whose name and/or whose behalf the Booking is made and/or whose name appears on the Booking Form, Invoices and Service Voucher and includes every person availing the services of the Company.
  • Tour Cost means the tour cost mentioned in the Indian Maharaja Itinerary / Indian Maharaja brochures / online and other payments such as surcharges, taxes etc payable to the Company by the Client.
  • Infant / Child : An 'Infant' means a person who is below the two years of age and a 'Child' means a person from two years of age and who is below twelve years of age.
  • We / Us / Train Manager means The Indian Maharaja-Deccan Odyssey.
  • Brochure - means printed brochure, online brochure, website, booklet, leaflet, and price grid.
  • Number - the singular shall include the plural.
  • Gender - the male shall include the female.
  • Website - means www.theindianmaharaja.com
STEPS TO BOOK YOUR TOUR ONLINE
Step 1:
Please log on to our website www.theindianmaharaja.com and read the online brochures / Itineraries, exclusions, inclusions, Terms and Conditions, Booking Conditions, and User Agreement in a careful manner.
Step 2:
Click on the “Book Your Royal Journey” link in “The Costs” section. Then choose your journey from these:
  • From Millionaire Dreams to Royal Dynasties (Mumbai to Delhi)
  • From Royal Dynasties to Millionaire Dreams (Delhi to Mumbai)

Fill in other relevant details and click the “Submit” button.

Step 3: The TIM office will respond to your booking request within 24 working hours of your booking, confirmation and the booking form.

Step 4: On completing the booking form, you can scan and email this to bookings@theindianmaharaja.com or fax it to TIM at + 91 - 11 – 2331 3320.Note: You can book the pre-tour night and also the accommodation post tour, and also extension programs in a similar manner through the website www.theindianmaharaja.com

PAYMENT
You can either make the entire payment in one go or you can pay as per the schedule herein:
USD 1000 per person - More than 90 days prior to departure. This amount will be non-adjustable and non-refundable.
Entire value of the ticket - to be paid within 90 days or less, from the date of departure.
If this is not done, the request will not be taken forward or actioned and the booking will be treated as cancelled. Therefore, relevant cancellation charges will apply, after deducting for services rendered.

You can also pay for the tour of your choice online, through the payment gateway at our other website, www.tcindia.com. Payments through fax credit card authorization or through bank transfer are also accepted; you can get these details from bookings@theindianmaharaja.com.
After completing the booking and payment formalities/conditions, a confirmation will be sent to you or to your travel agent. It is your / your travel agent's responsibility to check the confirmation and advise us immediately wherever any errors have been committed in booking your tour. A post containing your voucher and the itinerary will accordingly be sent to you within 14 days of the date of tour departure.
  • You will receive an acknowledgement for the amount paid, on paying the booking amount or on making the full payment
  • You will have to include any bank charges in your payment.
  • On the date of the transaction, the prevailing rate of exchange would be applicable.
  • TIM has the right to not authorise or decline your booking/s for any tour or for cancelling your booking without giving any reasons whatsoever.

CANCELLATION
Any changes that you may request in connection to your confirmed bookings must be given in writing to bookings@theindianmaharaja.com as early as possible. These requested changes, whether these include a change in name, or a change in the date of tour departure will be treated as a fresh booking and the confirmation of such changes will be subject to availability. Please note that all confirmed bookings are non-transferable and will invite a cancellation charge as is applicable.

a) Changes/Amendments
Any changes/amendment to the services would be considered as a cancellation of the original services and any new arrangements will be treated as an entirely new booking. Cancellation charges will apply as per the chart above.

If you wish to make any changes/amendments to your booking (such as change in tour departure date or the journey chosen by you) you must inform TIM by email at bookings@theindianmaharaja.com and fax a signed copy of the email to our processing office at + 91 - 11 – 2331 3320. The printout of the email faxed to us for any changes must be signed by the same person, who signed the Booking Form and / or your Travel Agent. It may not always be possible to make these requested changes and confirmation on the revised details will be subject to availability.

b) Changes and Cancellation by TIM prior to your departure
Tours are planned well in advance. We reserve the right to make changes to the programme at any point of time, wherever required. If a certain minimum number of passengers are not a part of a particular tour or due to certain operational conditions and reasons, we have the right to cancel the tour departure or change the same. Most changes that we make would be minor, but on certain occasions, it is possible that there would be a significant change. A change is significant if it involves a change of destination or a date of departure. In such an eventuality, we would let our Clients know as soon as possible and will include the following as part of our changes / cancellation procedure:
  • Accepting the changed arrangements or,
  • Purchasing alternative arrangements from us, similar in standard to those originally booked, if available, with the applicable cost adjustment or,
  • Cancelling or accepting the cancellation where you will receive a refund of the payment remitted to us. However, there will be no refund for any service such as pre / post accommodation, airline tickets, excursions, extensions etc. that have been booked by you and / or your Travel Agent.

c) Cancellation by you
If you wish to cancel your booking, you must communicate the cancellation to TIM by email at bookings@theindianmaharaja.com and fax a signed copy of the email to our processing office at + 91 - 11 – 2331 3320. Such a faxed communication should be signed by the person who signed the Booking Form and / or by your Travel Agent. Such notification will only be deemed to have been given on receipt of your email / fax, since we can only act once we have received the same. The computation of the period of notice of cancellation shall begin only from the time the signed fax copy reaches TIM by email at bookings@theindianmaharaja.com or by fax + 91 - 11 – 2331 3320 within working hours on working days. A cancellation charge is applicable for making the booking to compensate us and the possibility that we will be unable to resell your place in the time available. The cancellation policy above will apply.

In case of a 'force majeure' (please refer to details mentioned below) situation due to which a departure has to be cancelled, we regret to inform you in advance that we would not be able to refund the monies paid to us or that the there will be no reimbursement of any additional expenses you may have incurred as a result of our change / cancellation.

SURCHARGES
The prices shown are based on exchange rates and on known costs at the time of being published. TIM is not liable to make any changes.

In case of unforeseen increase in local or national taxation or any adverse fluctuation in currency exchange rates, affecting your tour cost in some way, we have the right to impose a surcharge or revise the cost of your tour.

TRAIN SCHEDULES AND FLEXIBILITY IN SCHEDULE
Please note that our train operates within the constraints of the Indian Railways Network and the timing agreed upon by them. We require you to abide by timings suggested by your guides, escorts, etc. enabling us to adhere to the schedules.

PROBLEMS AND COMPLAINT
Should you face any problem during your tour or should you have any complaints, please bring it to the attention of the Train Manager immediately, while on board, in order that you get an immediate solution to rectify the problem whilst on tour. Only then will the TIM have the opportunity to put matters right, at that moment. If you fail to do this, we reserve the right to compensate, which you may have, will be extinguished or reduced. If the problem persists, in the unlikely event, then please write to the TIM Customer Service team, either by email to feedback@theindianmaharaja.com or via fax to + 91 - 11 – 2331 3320 within 3 weeks of returning from the tour, providing us with the details of your booking reference and the exact nature of your complaint. If you delay beyond the stipulated time, this could affect our ability to investigate the complaint, which, in turn could impact the way that your complaint is dealt with.

FORCE MAJEURE
'Force Majeure' , in these booking conditions, means any event which we / the supplier of the service(s) in question / the Third Party Supplier, even with all due care, could not foresee or avoid. Such events may include riot, whether actual or threatened war, industrial dispute, civil strife, actual or threatened terrorist activity, unfavorable weather conditions, natural or nuclear disaster, fire disease, and all similar events outside the control of the concerned party.

We cannot pay any compensation or where the performance or prompt performance of our obligations under our agreement with you is prevented or affected by, or you otherwise suffer any damage or loss as a result of, 'force majeure'.

LAW AND JURISDICTION
Your relationship (and any contract you may have) with TIM or with any Third Party Supplier or any disputes or other matters arising from it shall be interpreted as per Indian Laws and Courts in Mumbai, India alone would have exclusive jurisdiction.

By signing the Booking Form, you / your agent on your behalf are accepting these terms and conditions.

OUR LIABILITY TO YOU
All arrangements for your holiday, we assure you, will be made and provided with utmost care and skill. This also means that we will accept responsibility if, for example, your contracted arrangements prove deficient as a result of the failure on our part, our employees or suppliers to use reasonable care and skill to make and providing your arrangements or are not provided as promised. We will be, further, responsible for what our employees and suppliers do or do not do, if they were at the time acting within the course of their employment or carrying out work we had asked them to do.

We will not be responsible for any injury, death, illness, damage, loss, cost, expense, or other claim of any description whatsoever which may results from:

  • the act(s) and / or omission(s) of a third party not connected with the provision of your arrangements and which were unavoidable or unforeseeable; or
  • the act(s) and / or omission(s) of the person(s) affected or any member(s) of their party; or any service or facility not arranged by us as part of our contract with you; or
  • 'force majeure' as defined above.
Where any claim or part of a claim (including those involving death or personal injury) concerns or is based on any travel arrangements, we will have to pay you the maximum amount of compensation limited to that provided under :
  • any relevant international conventions or regulation which apply to the travel arrangements in question.
  • public liability insurance taken by TCI.
We do not accept liability for:
  • any business losses;
  • any loss, damage, expense or other sum(s) of any description which, as per the information you may have given us during the course of the booking, we could not have foreseen, you would suffer or incur if we breached our contract with you;
  • excursions or other tours or any other travel services taken and paid for by you which have not been provided by us whilst you are on our tour.

In such instances, your contract will be with the operator / supplier of the excursion or tour or travel services and not with us.

PRIVACY OF INFORMATION
Although we try to maintain the privacy of the personal information provided by you, it may become necessary for us to share this information with Embassies, Consulates, Hotels, Airlines and other service providers who would be providing you service during the tour. We may also be bound to disclose such information if we were to receive an order from a court of law, subpoena, a requisition from any government or statutory authority, rules or regulations, or under any law such disclosure becomes necessary. The company has the right to publish letters / photographs / videos / emails / web pictures taken by you during the tour and also to track usage statistics online for our purposes. You have read the TIM Privacy Policy, the terms of which are deemed to be incorporated herein, and agree that the terms of such policy are reasonable. You agree to the use of your personal information by TIM, its associate and group companies and / or its third party providers and distributors as per the terms of and for the purposes set by the TIM Privacy Policy.

COMMUNICATION
All communication from you to us has to be in writing, not orally. If a communication has been transmitted to your email address / mailing address on record, this shall be deemed to have been communicated to you. Communications will be sent to you at your mailing address or e-mail address given in the Booking Form, where a booking is made directly by you with us. Communications from us will be sent to your agent, where a booking is made through a travel agent, through whom such booking has been received on your behalf and the agent would be responsible for passing on such communication to you. All monies paid to the travel agent shall not constitute payment to us unless these are deposited with us by your agent. The Company shall have the sole right to withdraw any such scheme or discount, in case of publication of any travel scheme offering any discount or benefit by us, at any time unless a specific assurance to the contrary is published.

CONDITIONS OF TRAVEL
The tour program will have to be strictly followed by you. There would be no refund if you fail to join the group at the commencement of the tour, or join the group later or leave the group before completion of the tour for any reasons whatsoever. You are responsible to register with the representative of TIM at the appointed date, place and time and you would be treated as a no-show if you fail to do so. Under no circumstances, for any unutilized services, would any refund be given. You shall not behave in a manner which may cause annoyance or distress to other co-travellers or which may cause damage to property of TIM or create the risk of danger to co-travellers or others. You may be asked to leave the tour immediately in this event. TIM shall hold no liability toward any such person.

TRAVEL INSURANCE
Since cancellation fees as applicable will not be waived off, it is mandatory that you purchase a trip insurance with an insurance company of your choice. You must supply TIM with the name, address and telephone number of your insurers, the 24-hour medical emergency telephone number and your policy number. If you have any pre-existing medical conditions, you must declare this to us and to your; if you fail to do so, this may invalidate your Travel Insurance Policy.YOUR FEEDBACK OR SUGGESTIONS
